Amendments to the EU dual-use items on the way

 On 20 October 2021, an informal version of the Commission Delegated Regulation (EU) …/… of 20.10.2021 amending Regulation (EU) 2021/821 of the European Parliament and of the Council as regards the list of dual-use items[1] and its Annexes[2] have been published.

Pursuant to Article 17 of the dual-use Regulation, the Commission may adopt delegated acts to amend the list of dual-use items (Annex I, II or IV). 

The list of controlled items at EU level was last updated in 2019 and until the end of February 2020. Yet, it needs to be further modified in order to reflect the changes to the control lists agreed by the relevant multilateral export control regime and arrangements until the end of 2020.

New amendments concern the following:

  • control parameters; 
  • the technical definitions and descriptions;
  • the removal or addition of dual-use items.  

As Annex I was amended – which includes items also listed in Annex IV -, Annex IV needs to be amended accordingly.

The amendments were adopted with prior transparent consultations of stakeholders and experts, as pursuant to specific interinstitutional act.[3]
